Petitioner, already in custody, seeks bail in connection with Ariyari P.S. Case No.70 of 2015 registered under Sections 341, 323, 325, 379, 307, 337, 338 and 504/34 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that due to land dispute, the petitioner shot at the informant causing firearm injury in his left thumb.

Learned counsel for the petitioner submits that there is land dispute and the injury is not on the vital part; whereas the leaned counsel for the State submits that the case is of the year 2015 and the petitioner twice moved anticipatory bail and despite direction in the earlier bail order, did not surrender

Patna High Court Cr.Misc. No.39244 of 2018(2) dt.09-07-2018 2/2 pursuant to that.

Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected.

The petitioner may renew his prayer of bail after framing of the charge.
