The petitioner seeks bail in anticipation of his arrest in connection with Narpatganj P. S. Case No. 283 of 2018 dated 18.05.2018 instituted for the offences under Sections 341, 323, 324, 354(B), 379, 504/34 of the Indian Penal Code.

The allegation against the petitioner and others is of having dug the earth without there being any right for the same and when it was protested, assault was perpetrated by the informant. One of the family members of the side of the informant is also alleged to have been misbehaved with.

Patna High Court CR. MISC. No.15549 of 2019(2) dt.14-03-2019 2/2 It has been submitted on behalf of the petitioner that the parties are agnates and come from the same family descent. There is a land dispute between the parties and counter version of the occurrence as well.

Considering the afore-stated facts and also taking into account their clean antecedents, the petitioner, abovenamed, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P. S. Case No. 283 of 2018 , subject to the conditions as laid down under Section 438 (2) Cr.P.C.
