The petitioner seeks bail in connection with Mohania Police Station Case No. 92 of 2017 (G.R. No. 403 of 2017) registered for offence punishable under section 396 of the Indian Penal Code.

It has been submitted that the case was registered under section 396 of the Indian Penal Code against 7-8 miscreants. In course of investigation, one Shrawan Kumar was arrested by Police who disclosed the name of one Pankaj Gupta. The said Pankaj Gupta divulged the name of this petitioner. There is nothing against this petitioner and he has been made accused merely on suspicion. It has been further submitted that the said Shrawan Kumar and Pankaj Gupta have been allowed bail by the different coordinate Benches of this Court in Criminal Misc.

Patna High Court Cr.Misc. No.46871 of 2017 (2) dt.21-09-2017 2/2 Nos.30869 and 19689 of 2017 on 06.07.2017 and 19.06.2017. The case of the petitioner stands on similar footing. He is in custody since 4.7.2017 and so, he also deserves to be enlarged on bail. The learned Additional Public Prosecutor on the other hand opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed and the petitioner- Vikash Yadav @ Allu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Bhabua at Kaimur, in connection with Mohania Police Station Case No. 92 of 2017 (G.R. No. 403 of 2017).
