Smt. Anusuiya Jaiswal ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Gogri P.S.Case No. 75 of 2018 registered under Sections 307, 326, 341, 448 and 504/34 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that due to children's quarrel of both sides, accused persons are said to have assaulted on the informant's side and specific accusation against petitioner is that he shot on the chest of the informant causing firearm injury to him.

Submission is that both sides quarreled on petty issue of fighting between the children of both sides and final opinion of doctor is that injury is simple in nature caused by hard and blunt substances.

Whereas learned counsel for the informant submits that

Patna High Court Cr.Misc. No.39246 of 2018(2) dt.06-07-2018 2/2 informant was treated in a private nursing home and it was a bullet injury.

Having considered the aforesaid facts and circumstances, in particular, the injury report of the Medical Officer, the petitioner, namely, Kusho Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Gogri P.S. Case No. 75 of 2018. (Arun Kumar, J) sujit/- U T
