2. The petitioner seeks regular bail in connection with Ujiarpur P.S. Case No. 306 of 2023 registered for the offence under Sections 302, 307, 353, 323/34 of the Indian Penal Code and Section 25(1-b)a, 26, 27, 35 of the Arms Act.

3. As per the prosecution case, when the police party want to arrest the accused persons, the accused including the petitioner are said to have killed the S.H.O.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 03.05.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as the gravity of the offence, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is hereby rejected.

8. The Court below is directed to expedite the trial of the petitioner.

9. The Superintendent of Police, Samastipur will ensure the attendance of the witnesses in the trial.

10. Let a copy of this order be communicated to the Superintendent of Police, Samastipur through FAX for its compliance forthwith.
