The petitioner seeks bail in POCSO Case No. 141 of 2021 arising out of Ekangar Sarai P.S. Case No. 290 of 2021 (G.R. No. 6858 of 2021) registered for the offence under Sections 341, 323, 354(B), 504, 506 and 34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.

As per the prosecution case, petitioner is alleged to have tried to outrage the modesty of the informant's daughter and also threatened her to kill if she refused to come to his terms.

It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. It is further submitted that the present case is false and

Patna High Court CR. MISC. No.17597 of 2022(2) dt.25-05-2022 2/2 concocted and it had been lodged as a counter blast only with a view to save skin from Ekangar Sarai P.S. Case No. 291 of 2021 dated 15.11.2021 in which F.I.R. was lodged by aunty of petitioner, namely, Usha Devi against the husband of the informant. Petitioner has no criminal antecedent and is in custody since 28.02.2022.

Learned APP vehemently opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, POCSO, Biharsharif, Nalanda in connection with POCSO Case No. 141 of 2021 arising out of Ekangar Sarai P.S. Case No. 290 of 2021 (G.R. No. 6858 of 2021).
