Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged against the petitioner that at the instigation of Mahesh Lal Deo he caused fire arm injury to the husband of the informant who succumbed to the injuries. The postmortem report corroborates the accusation. It is submitted by learned counsel for the petitioner that in subsequent statement the informant has stated that she is not the eye witness of the occurrence. Considering the nature of accusation, this Court is not inclined to grant privilege of anticipatory bail to the

Accordingly the application stands dismissed in connection with Baheri P.S. Case No. 251 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Darbhanga.
