2. The petitioner is apprehending his arrest in connection with Town P.S. Case No. 103 of 2024 dated 12.02.2024 registered for the offences punishable u/ss 413, 414, 307, 326 of the Indian Penal Code and 27 of the Arms Act.
3. As per the prosecution case, the co-accused Vicky @ Abhinav is alleged to have fired from the gun causing injury to Vikash Kumar due to dispute for distribution of money. It is further alleged that on the disclosure of the co-accused, Jai Prakash Yadav, one empty cartridge and a stolen motorcycle were recovered near the field of Rameshwar Tiwari.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.17508 of 2025(3) dt.31-10-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the co-accused person, Jai Prakash Yadav. The other co-accused person has been granted regular bail by this court vide order dated 23.07.2024 passed in Cr. Misc. No. 38500/2024. The specific allegation of firing is against the co-accused Vicky @ Abhinav. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Motihari, East Champaran in connection with Town P.S. Case No. 103 of 2024, subject to conditions as laid down under section 482(2) of the B.N.S.S., with further condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.17508 of 2025(3) dt.31-10-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
7. The application stands allowed.
