The petitioner seeks bail in Special Case No. 99 of 2017 arising out of Bahadurpur P.S. Case No. 138 of 2017 registered for the offence punishable under Sections 323, 353, 401 & 414 of the Indian Penal Code and Section 20/92 of the NDPS Act.
It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has been falsely implicated in this case. It has been further submitted that similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 30.03.2016 in Criminal Miscellaneous No. 11231 of 2016, dated 20.09.2017 in Criminal Miscellaneous No.44997 of 2017, dated 19.01.2018 in
Patna High Court Cr.Misc. No.40137 of 2018(2) dt.12-07-2018 2/2 Criminal Miscellaneous No. 3771 of 2018 and dated 04.07.2018 in Criminal Miscellaneous No.33042 of 2018. Petitioner is in custody since 03.11.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-III cum Special Judge, NDPS Act, in connection with Special Case No. 99 of 2017 arising out of Bahadurpur P.S.
