JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 24-05-2016 The petitioner apprehends his arrest in relation to Town P.S. Case No. 825 of 2014 registered under Section 387 of the Indian Penal Code.
The allegation by the informant is that the petitioner has rang up the informant several times from his mobile threatening and demanding ransom.
On behalf of the petitioner, it is submitted that the petitioner and informant are agnates. They are on heavy litigating terms. There is title suit, proceedings under Section 144 of the Cr.P.C., 145 of the Cr.P.C. between the fathers of the two persons. There are proceeding under Section 107 of the Cr.P.C. also pending and these allegations have been made falsely to pressurize

Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, East Champaran, Motihari in connection with Town P.S. Case No. 825 of 2014, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure, subject to condition that in case, the informant appear before the Court with evidence of any misconduct by the petitioner towards the informant in future, the Court may take such steps as it may deemed to fit including to cancel the bail bonds of the petitioner.
