Petitioners, already in custody, seek bail in connection with Maner P.S. Case No.70 of 2002, G.R. No.667 of 2002, registered under Sections 447, 341, 323 and 337/34 of the Indian Penal Code.

This is a case of misuse of privilege of bail. The petitioners did not appear after commitment of the case. Learned counsel for the petitioners submits that the petitioners had no knowledge about the processes issued by the court and the petitioners are labourers and had gone outside the State to earn livelihood.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.4068 of 2018 (2) dt.19-01-2018 2 /2 petitioners Mogal Rai @ Mangal Rai and Sohan Rai are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Danapur (Patna) in connection with Maner P.S. Case No.70 of 2002, giving rise to Sessions Trial No.1757 of 2010 with condition that the petitioners shall be present on each and every date before the trial court and in case of their absence on two consecutive dates without any medical emergency, their bail bonds shall liable to be cancelled.
