The petitioner seeks regular bail in S. Tr.No.103 of 2017 arising out of Barauni (Chakiya) P.S.Case No.76 of 2016 registered for the offence punishable under Section 302 & 34 of the I.P.C.

Admittedly, the prayer for bail of the petitioner was refused vide order dated 15.03.2017 passed in Cr.Misc.No.8235 of 2017 taking into consideration the direct allegation of shot fired on the deceased from katta.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.04.2016 but the trial has not yet been concluded and now only I.O. has to be examined. Having considered the facts and circumstances as well
