Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with G.R. No. 1800/2020, arising out of Konch P.S. Case No.126/2020 for the offence punishable under Sections 341, 323, 308, 504, 509/34 of the Indian Penal Code. The specific allegation against the petitioner is that he assaulted the informant with lathi.

The learned counsel for the petitioner has submitted that there was previous enmity between the parties and prior to

Patna High Court CR. MISC. No.27985 of 2021(2) dt.10-03-2022 2/2 lodging of this F.I.R., the father of the petitioner has lodged Konch P.S. Case No. 127/2020 against the informant's side. The petitioner's side have also sustained injuries. The specific allegation against the petitioner is that he assaulted the informant. The injury, sustained by the informant, is simple, caused by hard and blunt object.

Considering the above mentioned facts and circumstances, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gaya in connection with G.R. No.1800/20, arising out of Konch P.S. Case No. 126/2020, subject to condition as laid down under Section 438 (2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
