Petitioner seeks bail in connection with Town (Ratanpur) P.S. Case No. 169 of 2014 registered for the offence punishable under sections 364A, 302, 201, 120B and 34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report. He has been implicated in this case on the basis of confessional statement of the co-accused. It is further submitted that during trial witnesses have not alleged anything against this petitioner. Moreover, similarly situated co-accused has been granted bail by different co-ordinate Benches of this Hon'ble Court vide orders dated 11.02.2015, 12.03.2015, 13.04.2015,

Patna High Court Cr.Misc. No.38555 of 2018(3) dt.19-07-2018 2/2 28.07.2015 and 02.09.2015 passed in Cr. Misc. Nos. 45693 of 2014, 7783 of 2015, 46162 of 2014, 27073 of 2015 and 19057 of 2015 respectively. Learned counsel has produced the web copies of the aforesaid orders, which is kept on record. Petitioner is in custody since 16.03.2017.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Town (Ratanpur) P.S. Case No. 169 of 2014.
