JUSTICE GOPAL PRASAD ORAL ORDER 06-02-2015 The learned counsel for the petitioners submits that petitioner no. 4, above named, has been arrested, hence, prays to withdraw the case on his behalf.

Prayer is allowed.

The prayer for anticipatory bail of petitioner no. 4 is dismissed as withdrawn.

Heard the learned counsel for the petitioners and the State.

This is a petition for grant of anticipatory bail for offence under Sections 147, 149, 448, 323, 324, 307, 384, 506, 504 and 379 of the Penal Code.

This is a case of case and counter case though there is allegation of assault by the petitioners, but, the injuries found to be lacerated and simple in nature.

Hence, having regard to the facts and circumstances of the case, the petitioners 1, 2 and 3, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, are directed to be released on anticipatory bail on

Patna High Court Cr.Misc. No.33348 of 2014 (2) dt.06-02-2015 2/2 furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with the Kharagpur P.S. Case No. 10 of 2014 to the satisfaction of the Chief Judicial Magistrate, Munger, subject to the conditions laid down under Section 438(2) of the Criminal Procedure Code and the petitioners will cooperate with the investigation during investigation and after submission of the charge sheet shall appear before the Court to receive police papers.
