The petitioner who is a Ward Member of Ward No. 32 of Nagar Parishad, Danapur has moved this Court seeking cancellation of the notice inviting tender issued at the instance of respondent no. '4' i.e. the Executive Officer, Nagar Parishad, Danapur.

It is his grievance that while majority of Wards of Danapur Nagar Parishad have been allotted Rs. 30-40 lacs and tenders have been invited for the said value, the majority of the funds are being provided to the Chief Councilor and the developmental work of other Wards are being affected due to

In the opinion of this Court, such issue cannot be adjudicated by this Court. It is open for the petitioner to bring the entire matter to the notice of the Principal Secretary, Urban Development and Housing Department, Government of Bihar as also the Executive Officer, Nagar Panchayat, Danapur by filing an appropriate representation.

If such representation is filed by the petitioner, the concerned authority shall look into the same and take an appropriate decision thereon within a period of three months from the date of filing of the representation along with a copy of this order.
