Petitioner seeks bail in Neemachandpura P.S. Case No.07 of 2019 registered under Sections 147, 148, 149, 379, 385, 341, 323, 386, 307, 504 and 506 of the IPC and under Section 27 of the Arms Act.
The informant alleged that the petitioner and other accused persons armed with different weapons went to the land of the informant and they demanded ransom. One of the coaccused shot fire on the informant but the informant anyhow escaped. The petitioner is alleged to have touched a pistol on the waist of the informant and took Rs.33,000/- from possession of the informant.
Learned counsel for the petitioner submits that the petitioner is a co-villager of the informant and on account of
Patna High Court CR. MISC. No.16408 of 2020(2) dt.03-06-2020 2/2 land dispute, the petitioner has falsely been implicated in the case. The petitioner is in jail since 27.12.2019. Having considered the facts and the nature of allegations made against the petitioner and the fact that the petitioner is a co-villager of the informant and there is a land dispute and the petitioner has already remained in jail for more than five months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Neemachandpura P.S.
