The petitioner apprehends his arrest in connection with Obra P.S. Case No.457 of 2022, registered for the offences punishable under Sections 341, 323, 504, 506, 379, 385, 307, 325 and 34 of the Indian Penal Code.

The petitioner and other co-accused persons are said to have assaulted the informant by means of iron rod causing bleeding injury in his head. When the son of the informant came to save his father, he was also assaulted by the accused persons by means of iron rod causing fracture injury in his left leg. It is also alleged that petitioner and co-accused, Amritesh Kumar snatched chain made of gold and Rs.10,000/- from possession of the informant.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.17031 of 2023(4) dt.03-07-2023 2/2 petitioner is innocent and has falsely been implicated in the present case. It is submitted that petitioner has got three criminal antecedents as stated in paragraph-3 of the bail petition. It is further submitted that the injuries sustained by the injured persons are simple in nature. It is submitted that there is case and counter case between the parties.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Considering the nature of injuries, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad (Bihar) in connection with Obra P.S. Case No.457 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
