JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Motihari Town P.S. Case no. 33 of 2017 registered for the offence punishable under Sections 457, 380 and 511/34 of the Indian Penal Code.

The petitioner and other accused are said to have intruded into the house of the informant to commit theft by breaking lock of the door and was apprehended from its washroom.

It is submitted by the learned counsel for the petitioner that the petitioner used to work as labour with the informant and his wages was due to the informant. When he

Patna High Court Cr.Misc. No.50443 of 2017 (2) dt.18-10-2017 2/2 approached the informant to demand the same, he caught hold the petitioner and falsely implicated in the case. The petitioner has been languishing in custody since 16.01.2017. He has no criminal antecedent. Similarly situated co-accused namely, Md. Sabu has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 21.09.2017 passed in Cr. Misc. no. 45084 of 2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sadar, Motihari in connection with Motihari Town P.S. Case no. 33 of 2017.
