JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 14.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Doriganj P. S. case no. 21/2015 registered under sections 307, 379 and other allied sections of the Indian Penal Code. Petitioners are said to have given farsa blow to the informant but annexure 2, injury report of the informant, reveals that he sustained only one injury near his left eye. The opinion regarding the aforesaid injury was kept reserved but admittedly, up till now, no x- ray report was placed before doctor.

So far as other injured is concerned, admittedly, said injured sustained simple injury. Moreover, there is counter case also and in the counter case, Sakuntala Devi and some others

It would appear from the record that alleged occurrence of both the cases are said to have taken place on 20.3.2015 but both the cases registered on 3.4.2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Doriganj P. S. case no. 21/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
