The petitioner has filed the instant application for grant of regular bail in connection with Falka P.S. Case no. 416 of 2017 registered for offence under section 414 of the Indian Penal Code.

As per allegation in the F.I.R., on a raid being conducted on the house of the petitioner, while the petitioner managed to escape, a red coloured motorcycle was recovered from his house for which no papers were produced.

It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place from his house and it is after arrest in the present case that he has been remanded in other cases without any legal evidence. The petitioner is in

Patna High Court CR. MISC. No.14983 of 2020(3) dt.02-06-2020 2/2 custody since 27.11.2019.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner being in custody since 27.11.2019, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Falka P.S. Case no. 416 of 2017 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
