JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This application, for grant of anticipatory bail, arises out of (Rustampur O.P.) P.S. Case No. 85/18, disclosing offences under Sections 304(B) and 34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and allegation against him is of causing dowry death of the deceased..

Submission of learned counsel for the petitioner that the has falsely been implicated in this case and the witnesses during investigation has stated that the deceased committed suicide.

Learned counsel for the State opposed the prayer for bail and submitted that the petitioner is husband of the

Patna High Court CR. MISC. No.19041 of 2019(2) dt.08-05-2019 2/2 deceased and several witnesses have supported the allegation. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
