The present application has been filed for quashing the First Information Report of Patna Kotwali P.S. Case No. 331 of 2015 registered under Sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code.

Mr. Vikash Nagwan, learned counsel for the petitioners very fairly submits that final report under Section 173(2) Cr.P.C has already been submitted and consequently

Patna High Court Cr.Misc. No.24168 of 2016 (2) dt.02-09-2016 2/2 order of cognizance has been passed. It is further submitted that the issue has been resolved between the parties and a joint compromise petition has been filed before learned Chief Judicial Magistrate, Patna which has been brought on record as Annexure-2.

In the circumstances, the application has become infructuous.

Accordingly the application is disposed of with liberty to the petitioner to challenge the order passed by learned Chief Judicial Magistrate, Patna on submission of final report.
