Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code.
The accusation is kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that for the occurrence of 29.12.2014 the First Information Report was registered on 01.01.2015. The victim in her 164 Cr.P.C. statement has stated that she went in the company of the petitioner on promise by the petitioner to get married with the victim but subsequently the petitioner refused to marry. It is alleged that petitioner established physical relationship with the victim girl.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.24963 of 2015 (2) dt.30-06-2015 2/2 petitioner that medical opinion suggest that victim was on the verge of attaining majority and 164 Cr.P.C. statement of the victim girl suggests that she of her own went in the company of the petitioner.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Amarpur P.S. Case No. 01 of 2015, pending in the Court of learned Chief Judicial Magistrate, Banka.
With the observations above, the application stands disposed off.
