JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 A supplementary affidavit has been filed on behalf of the petitioners. Keep it on the record.

Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 504, 324 and 307 of the Indian Penal Code and Section 27 of Arms Act.

The allegation against the petitioners is that they took out pistols and made firing, which hit on the right hand of the informant and on the hydrosol of Mukesh Kumar and one Nand Lal Das also got bullet injury on his abdomen and hand when he reached on hulla and one Binod Kumar was also with Sonu and Manish.

Patna High Court Cr.Misc. No.25543 of 2015 (3) dt.23-09-2015 2/2 It has been submitted on behalf of the petitioners it is a case and counter case. Both sides have sustained injury in course of the occurrence. Vide Annexure 4 to the supplementary affidavit, the matter has been compromised between the parties. On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Muzaffarpur, in connection with Bela P.S.Case no. 15 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
