2. The petitioner apprehends her arrest for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. A perusal of the first information report and the seizure list would go to show that a total 10 liters of country made liquor is said to have been recovered from a bucket which was being carried out by the petitioner and the petitioner managed to escape but the police recovered and seized the liquor.

4. Learned counsel for the petitioner submits that there is no recovery from the conscious or physical possession of the petitioner. The petitioner has been falsely implicated in

Patna High Court CR. MISC. No.16569 of 2025(4) dt.24-06-2025 2/2 this case as the said recovery has been made from near her house. The name of the petitioner has surfaced in this case merely on suspicion disclosed by people of the vicinity.

5. Taking into consideration the abovementioned facts and circumstances of the case and further that the petitioner is a lady and has no criminal antecedent, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court in connection with Phulwarisharif P.S. Case No.568 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and subject to the further condition that the petitioner shall cooperate in the investigation/trial.
