JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 24.07.2017 in connection with Shikarpur P.S.Case no. 338 of 2006 registered under Sections 20/22 N.D.P.S.Act.

This is a case of misuse of privilege of bail. Considering the fact that the petitioner had gone out to earn his livelihood, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge Vth, Bettiah, West Champaran in connection with Shikarpur P.S.Case No. 338 of 2006 (Trial No. 19 of 2007),subject to the following conditions:

Patna High Court Cr.Misc. No.48716 of 2017 (2) dt.18-10-2017 2/2 (i) that one of the bailors shall be a close relative of the petitioner.

(ii) that the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bonds shall be liable to be cancelled by the learned court concerned.
