JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in Singheshwar P.S. Case No.151 of 2014 for the offences instituted under Sections 304(B) and 120(B)/34 of the Indian Penal Code. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that there is accusation of conspiracy in assaulting and committing murder of the daughter of the informant by strangulation against the petitioner along with others. It is further alleged that the petitioner along with other accused persons threw her dead body in the cattle shed of Md. Salim.

It is submitted on behalf of the petitioner that the petitioner being mother-in-law of the deceased has made

Patna High Court Cr.Misc. No.28724 of 2015 (2) dt.23-07-2015 2/2 conspiracy along with other co-accused persons in torturing, assaulting and committing murder of the daughter of the informant. It is further submitted that the petitioner is separate in mess and property from the husband of the deceased. It is further submitted that the petitioner has no criminal antecedent. On behalf of the State it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Madhepura, in Singheshwar P.S. Case No.151 of 2014 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Sudhir Singh, J) AnilKrSinha/- U T
