ANJANA MISHRA ORAL ORDER 02-08-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kesariya P.S. Case No.48 of 2016 for allegedly having committed the offence under Sections 147, 148, 341, 323, 324, 325, 307 and 379 of the Indian Penal Code.
Mr. Y.V. Giri, learned Senior Counsel appearing on behalf of the petitioners submits that there was a land dispute between the parties and there was an occurrence in which there
Patna High Court Cr.Misc. No.20637 of 2016 (3) dt.02-08-2016 2/2 is case and counter case between them. Both the parties are said to have received injuries. The injury reports, which have been annexed, indicate that most of the injuries inflicted are simple in nature and are of hard and blunt substance. Considering the entire facts and circumstances of the case and there is case and counter case in which both the parties have received injuries, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Kesariya P.S. Case No.48 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
