The petitioner apprehends his arrest in Jagdishpur P.S. Case No. 406 of 2021, registered for the offences punishable under Sections 286, 307/34 of the Indian Penal Code and section 3/4 of the Explosive Substance Act.
As per the prosecution case, FIR named accused persons were apprehended with live explosives. It is submitted that petitioner is not named in the FIR. Name of this petitioner transpired in this case on the basis of confessional statement of co-accused. No incriminating article has been recovered either from possession of this petitioner or from his premises.
Considering the facts aforesaid, the petitioner above-
Patna High Court CR. MISC. No.18256 of 2022(2) dt.29-08-2022 2/2 named, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cumSpecial Judge Vigilance (Trap Act), Bhagalpur in connection with Jagdishpur P.S. Case No. 406 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
