Petitioners seek bail in Katihar Rail P.S. Case No.02 of 2020 registered under Sections 401, 411, 414, 379 and 34 of the IPC and under Sections 20 and 22 of the N.D.P.S. Act as well as under Sections 137 and 147 of the Indian Railway Act. The petitioners are said to have been arrested from Katihar Railway Station and from their possession, Ativan tablets and other articles were recovered.

Learned counsel for the petitioners submits that nothing has been recovered from possession of the petitioners. The petitioners have falsely been implicated in the case. They

Patna High Court CR. MISC. No.16403 of 2020(2) dt.03-06-2020 2/2 are in custody since 08.01.2020. The petitioners have already remained in jail for about five months.

Having considered the facts and the nature of allegations made against the petitioners and the fact that the petitioners are in jail since 08.01.2020, the petitioners named above are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(rupees ten thousand) each with two sureties of like amount each to the satisfaction of learned Court of Railway Judicial Magistrate, Katihar in connection with Katihar Rail P.S. Case No.02 of 2020 corresponding to G.R. (Rail) No.04 of 2020.
