The petitioners seek pre-arrest bail in connection with Saharghat P. S. Case No. 70 of 2015 registered under Sections 341, 323 and 353/34 of the Indian Penal Code. It is contended by learned counsel for the petitioners that the petitioners are neither named in the FIR nor any incriminating article has been recovered from their possession. It is further contended that their name has been transpired in course of investigation merely on suspicion. It is also contended that the FIR

No.20621 of 2016 (2) dt.26-05-2016 2/2 named accused Bipat Panjiyar has already been granted pre-arrest bail by a co-ordinate Bench of this Court vide order dated 19.02.2016 passed in Cr. Misc. No. 7432 of 2016. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners, who are said to be of clean antecedent, are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Benipatti, District Madhubani in Saharghat P.
