JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Piar P. S. Case No. 59 of 2017, registered under Sections 326, 307/34 of the Indian Penal Code and 27 of the Arms Act. The accusation is that the informant Rajeev Kumar along with Sita Ram Sahni was sitting at the door of Amaresh Sahni on the occasion of marriage. Meanwhile the informant saw Vikash Sahni sitting with his friend at some distance. In the meantime, the informant saw that Vikash Sahni handed over his pistol to his friend, who fired at his uncle, Sita Ram Sahni, causing injury to his uncle and also three children. Thereafter, Vikash Sahni and his friend started to flee away with the help of villagers, friend of Vikash Sahni was apprehended, who disclosed his name,

Learned counsel appearing on behalf of the petitioner submits that in fact the petitioner was going to Muzaffarpur from Hajipur. In the way, when he heard sound of firing, then he stopped his motorcycle in the meantime he was apprehended by the villagers mere on suspicion. Further submission is that the injury of three injured children, as detailed in cased diary, were of hard and blunt substance while charge sheet has been submitted but injury report of Sita Ram Sahni has been collected while Sita Ram Sahni in his statement as detailed in para-20 he disclosed that he was under treatment of Dr. Rajiv Bhushan Sinha at Muzafffarpur and pellet was removed to his shoulder. The petitioner is in custody since 20.06.2017.

Considering the period of custody, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge -cum- Additional Chief Judicial Magistrate- V, Muzaffarpur in connection with Piar P.S.Case No. 59 of 2017, subject to the conditions that one of the bailors would be a close relative of the petitioner.
