The petitioner, already in custody, seeks bail in connection with Bangaon P.S.Case No. 127 of 2017 registered under Section 393 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that some unknown miscreants made an attempt to commit robbery with the informant's tempo while he was driving it and shot at him causing injury in his arm. Submission is that merely on the basis of confessional statement before the police, petitioner has been made accused in this case however neither any arm nor any other incriminating article has been recovered from his possession and he has only one antecedent under Section 395 IPC, in which he is on bail and has been in custody since 11.01.2018, however, investigation was completed but during investigation he was not

Having considered the aforesaid facts and circumstances, the petitioner, namely, Prakash Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Saharsa in connection with Bangaon P.S. Case No. 127 of 2017.
