The petitioners being uncle and cousin of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Section 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for nonfulfillment of dowry demand. It is submitted by learned counsel for the petitioners that petitioners are separate from the husband of the informant since 32 years and the thrust of accusation is against the husband and other family members of the informant.
It is submitted by learned counsel for the informant that though in the FIR she alleged that she was married with Praveen
Patna High Court Cr.Misc. No.25849 of 2015 (2) dt.17-07-2015 2/2 Kumar but, subsequently, she claimed that she was actually married with petitioner no.2.
Considering the fact that it is specifically mentioned in the FIR that the informant claimed to have married with Praveen Kumar, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur in connection with Maner P.S. Case No.508 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
