2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 409 of the Indian Penal Code.
3. As per the prosecution case, petitioner is alleged to have misappropriated the amount of Rs. 14,91,284/-.
4. It is submitted on behalf of the petitioner that as soon as the petitioner came to know about the incident, he immediately deposited the defalcated amount with interest i.e. Rs. 17,22,874/- in the account of the Government at Darbhanga Head Office. Petitioner claims clean antecedent.

5. Learned counsel for the Union of India does not dispute the contention made on behalf of the petitioner.

Considering the fact that petitioner has already deposited the defalcated amount, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Darbhanga in connection with L.N.M.U. P. S. Case No. 08 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
