JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 366A/34 and 363 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant, though, thrust of accusation is against Vijendra Ram but since the petitioners are the mother and sister-inlaw(bhabhi) of the main accused Vijendra Ram, hence they alleged to have abetted the whole offence.
It is submitted by learned counsel for the petitioners that the victim is not minor and she of her own married with Vijendra Ram and both are absconding.
Considering the fact that the thrust of accusation is
Patna High Court Cr.Misc. No.25418 of 2015 (2) dt.14-07-2015 2/2 against Vijendra Ram, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur (Bhabua) in connection with Kudra P.S. Case No. 80 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
