Petitioner is in jail custody since 1.9.2018 in connection with Amour P.S. Case No. 117 of 2018 registered for the offences punishable under Sections 363, 366A, 420, 376, 384 and 506/34 of the Indian Penal Code.

Petitioner is said to have kidnapped the victim and forcibly established physical relation but the report of learned trail court goes to show that the prosecution has already adduced his evidence and the trial of the petitioner is pending for defence evidence as well as argument.

The aforesaid fact goes to show that there is no possibility of hamper of prosecution evidence since the prosecution evidence has already been recorded.
