The petitioner apprehends his arrest in Bisfi P.S. Case No. 291 of 2021, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

It is submitted that specific allegation of firing and assault is against co-accused persons. So far as this petitioner is concerned, he is simply member of unlawful assembly and there is no allegation of any overt act against this petitioner. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner above-

No.17773 of 2022(2) dt.29-08-2022 2/2 named, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Benipatti, Madhubani in connection with Bisfi P.S.
