JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-11-2023 The present writ petition has been filed seeking the following reliefs:- "1(A). For issuance of writ in nature of mandamus for direction to the respondent no.3 to obey and follow judicial order dated 20-02-2019 passed in Aanganabdi Seva Appeal Case No. 59/2016 passed by the respondent no.2 whereby the authority in view of 1st position of the petitioner in the panel of merit list, a direction was given for selection and appointment of petitioner on the post of Aanganabdi Sevika of Aanganabdi Centre No- 56 located in Ward No. 13 of Gram Panchayat Mathurapur Kahtarwa but despite of aforesaid judicial order respondent no.3 miserably

Patna High Court CWJC No.4947 of 2022(2) dt.23-11-2023 2/2 failed to execute or implement direction given therein with respect to right of petitioner for selection and appointment on the post of Aanganbadi Sevika.

(B). For direction to respondent no.3 to obey the direction given under Letter No. 514 dated 08-072019 issued by the Legal Section of the District Magistrate, Sheohar office whereby respondent no.3 is directed to abstain from publishing new advertisement in pendency of case for selection and appointment of Aanganbadi Sevika for the Aanganabadi Centre No. 56 located in ward No. 13 of Gram Panchayat Mathurapur Kahatarwa."

The learned counsel for the petitioner, at the outset, submits that the District Programme Officer, Sheohar, has already passed the final order dated 17.2.2022, as contained in memo no. 18.2.2022, hence, the petitioner be granted liberty to challenge the same in accordance with law. Liberty, so sought, is granted.
