2. Petitioner apprehends arrest in a case registered for the offence punishable under section 414 of Indian Penal Code and Section 30 (a) , 32 ( ii ), 38 ( ii ), 41 ( i ) of Bihar Prohibition and Excise Act.
3 . It is alleged that total 315 liters foreign liquor was recovered from seized truck bearing registration No. BR06G 5361 and Alto Car bearing registration No. BR 31K 8653 .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . Petitioner is neither owner nor driver of seized vehicles. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way

5 . Learned counsel for the State opposes the bail petition.
6. Considering the fact that petitioner is neither owner nor driver of seized vehicles, clean antecedent and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Court No. II Vaishali in connection with Mahua Police Station Case No. 651 of 2021 subject to the conditions laid down under section 438 ( 2 ) of Code of Criminal Procedure .
