The petitioner seeks bail in connection with Kishanganj P.S. Case No. 175 of 2017 dated 12.04.2017 instituted for the offences under Sections 376, 302/201/34 of the Indian Penal Code and Section 6 of the POCSO Act, 2012.

The sister of the wife of the informant was raped and killed. Initially a suspicion was raised against one Shambhu Thakur who confessed that the petitioner had committed rape on her and thereafter the deceased was killed.

Learned counsel for the petitioner has submitted that at best the evidence against the petitioner would be only the confession of a co-accused

Patna High Court Cr.Misc. No.39984 of 2018(2) dt.10-07-2018 2/2 and on the aforesaid material, the petitioner is in jail for about 15 months by now.

However, considering the nature of accusation against the petitioner, I am not inclined to grant bail to the petitioner.

The prayer for bail is hereby rejected.
