Petitioner was applicant for allotment of house in the year 1978.

For 41 years, the petitioner was kept awaiting allotment but instead of selling dreams nothing concrete was done by the Housing Board. The Housing Board has taken stand to refund the amount of the allottee.

Considering the aforesaid, the writ petition is disposed of with direction to the Housing Board to take decision in terms of their own decision for refund of amount of the allottee of the flat.

Let the Housing Board refund the entire amount to

Patna High Court CWJC No.13956 of 2014(2) dt.20-06-2019 2/2 the petitioner with interest at the rate of 8 per cent per annum which is admissible to the allottees of Digha to this petitioner within a period of 30 days from today, failing which the amount shall carry additional interest at the rate of five per cent per annum from the date of deposit till the date of actual refund. Extra amount of interest shall be realized from the pocket of the Managing Director, Estate Officer and Revenue Officer of the Housing Board.
