JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-11-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Dariyapur P.S. Case No. 287 of 2016 registered under Sections 341, 323 and 307 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is said to have closed the mouth of the informant from rear side while co-accused Birendra Singh assaulted on his chest and thigh by means of revolver inflicting bleeding injury to him.

It is submitted by learned counsel for the petitioner that the petitioner does not happen to be the assailant of the victim. He has been falsely implicated in the case due to land dispute as title suit between the petitioner and the informant and others is

Patna High Court Cr.Misc. No.53984 of 2017 (2) dt.13-11-2017 2/2 pending preceding to the case under hand. The petitioner has been languishing in custody since 16.08.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Saran at Chapra in connection with Dariyapur P.S. Case No. 287 of 2016.
