2. Petitioner is apprehending his arrest in connection with a case registered for the offences under Sections 341, 342, 420, 379/34 of the Penal Code with regard to theft of a tractor seized from a place outside the house of the petitioner.
3. It is submitted on behalf of the petitioner that the land on which the tractor was standing belongs to some other person.
4. In the light of the fact that the house of the petitioner is just in front of the land where tractor was parked, petitioner should be well advised to surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and apply for regular bail, which should be considered in accordance with law in the
Patna High Court Cr.Misc. No.33462 of 2014 (2) dt.04-02-2015 2/2 light of his antecedent. In case, petitioner besides the present case is accused in only one another case mentioned in paragraph 3 of the petition he be released on bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case No.249/12, subject to the conditions laid down under Section 438(2) Cr.P.C. Necessary verification about the antecedent of the petitioner should be made within a period of four weeks from the date of receipt/ production of a copy of this order.
