Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Balua Bazar Police Station Case No. 06 of 2016, disclosing offences under Sections 467, 468, 471, 420/34 of the Indian Penal Code.

The petitioner's wife, Priyanka Devi, was working as an agent in Mahila Pradhan Kshetriya Bachat Yojana. She is said to have taken amount from the depositors and showing false entries in the respective pass

Patna High Court Cr.Misc. No.22788 of 2016 (3) dt.14-07-2016 2/3 books of the said depositors, she misappropriated a huge amount to the tune of Rs. 6,63,400/-. The petitioner is the husband of said Priyanka Devi. It is alleged against him that he used to make false entries in the pass books. Learned Counsel appearing on behalf of the petitioner has submitted that the petitioner's wife had deposited a sum of Rs. 6,62,130/- by December, 2014. Without taking into account the amount already deposited by the petitioner's wife, in the First Information Report, a sum of Rs. 6,63,400/- is said to have been misappropriated by the petitioner and his wife. It has been submitted, with reference to annexures to the present application, that rest amount of Rs. 1270/- has also been deposited after registration of the First Information Report. Considering the above submission, this application is allowed.

Let the petitioner, Gopi Krishna @ Krishna Kant Singh, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Balua Bazar Police Station Case No. 06 of 2016, subject to the condition laid down under Section 438 (2) of the Code

Patna High Court Cr.Misc. No.22788 of 2016 (3) dt.14-07-2016 3/3 of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
