JUSTICE ARUN KUMAR ORAL ORDER 12-07-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Arwal Mahila P.S.Case No. 16 of 2017 registered under Sections 328,341,342,376 and 120B/34 of the Indian penal Code and 4 of the Protection of Children from Sexual Offences Act.

Learned counsel for the petitioners seeks bail on the ground of parity as main accused Krishna Paswan was admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 26958 of 2018 against whom there was specific accusation of committing rape but there is no allegation against these petitioners of raping the prosecutrix. It is also submitted that there was love affair between the prosecutrix and Krishna

Patna High Court Cr.Misc. No.41753 of 2018(2) dt.12-07-2018 2/2 Paswan and he was granted bail considering the fact that he had married with the prosecutrix and leading their conjugal life. Having considered the aforesaid facts and circumstances, the petitioners, namely, Saheb Paswan, Vakil Paswan and Pundeo Paswan @ Punyadeo Paswan, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Jehanabad in connection with Arwal Mahila P.S.
