JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Excise Case No. 340 of 2018 arising out of Jehanabad P.S. Case No. 253 of 2018 for the offenses under Sections Section 30(a), 37(b) of the Bihar Prohibition & Excise Act, 2016 and Sections 25(1B) a, 26/35 of the Arms Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 6.4.2018. he was arrested in intoxicated condition and from his possession it is alleged that one live cartridge was recovered. Considering the fact that the petitioner has remained in custody for more than three months, charge sheet has already been submitted and similarly circumstanced co-accused
Patna High Court Cr.Misc. No.38889 of 2018(2) dt.09-07-2018 2/2 Bindeshwar Singh and another were granted bail by this Court in Cr. Misc. No. 28702 of 2018 vide order dated 10.5.2018, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-II, Jehanabad in connection with Excise Case No. 340 of 2018 arising out of Jehanabad P.S. Case No. 253 of 2018.
