The petitioner seeks regular bail in connection with Basantpur P.S. Case No.243 of 2017 instituted for the offences under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 332, 353, 272, 273/308, 504, 506 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding the accused persons including the petitioner herein having surrounded one Amrendra Singh and having kept him in confinement with oblique motive where after the police had apprehended the accused persons and recovery of various quantities of illicit liquor is said to have been
Patna High Court Cr.Misc. No.59144 of 2017 (2) dt.22-12-2017 2/2 made from various places, i.e., the house of the accused persons and the vehicle of the accused persons.
The learned counsel for the petitioner submits that as far as the petitioner is concerned, there is general and omnibus allegation against him and no recovery whatsoever has been made from the petitioner herein. It is submitted that the petitioner is languishing in custody since 13.07.2017.
In the facts and circumstances of the present case, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.1,00,000/- (rupees one lac) with two sureties of the like amount each to the satisfaction of learned Additional Sesions Judge-II, Siwan in connection with Basantpur P.S. Case No.243 of 2017. It is further directed that the petitioner shall made his attendance before the SHO of the concerned police station at 10 A.M. on each Monday of the week and in default of appearance, the present privilege of bail shall stand cancelled automatically and the petitioner would be taken into custody forthwith.
