The petitioner is languishing in custody since 28.12.2018 in a case registered for the offences punishable under Sections 414/34 of the I.P.C.

The prosecution case is that the petitioner was apprehended while driving a stolen motorcycle.

It is submitted by learned counsel for the petitioner that the petitioner had no knowledge that the motorcycle in question is stolen one. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner was caught with stolen motorcycle.

Considering the fact that the investigation has already been concluded, statement made in paragraph 3 of the petition

No.17354 of 2019(2) dt.28-03-2019 2/2 that the petitioner is not having any criminal antecedent. and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM XV, Gopalganj in connection with Kateya P.S. Case No.395 of 2018.
